These Terms & Conditions (“Terms”) govern access to and use of the DonationPe platform (“DonationPe”, “Platform”, “we”, “our”, or “us”), owned and operated by Webenor Technologies Private Limited, India.

By accessing or using DonationPe, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Definitions

  • “DonationPe” means the technology platform operated by Webenor Technologies Private Limited.
  • “Organization” means any trust, NGO, institution, or entity registered on DonationPe to collect donations.
  • “Donor” means any individual or entity making a voluntary donation through DonationPe.
  • “Donation” means a voluntary monetary contribution made by a Donor to an Organization.
  • “Payment Gateway” means the third-party payment processor selected and operated by the Organization.
  • “Services” means the technology services provided by DonationPe to facilitate donation transactions.

2. Nature of the Platform

2.1 DonationPe is a technology intermediary that enables Organizations to accept voluntary donations through their own payment gateway accounts.

2.2 DonationPe:

  • Does not receive, hold, or control donation funds
  • Does not determine or monitor utilization of donations
  • Is not a beneficiary of donations made through the Platform

2.3 All payments are processed directly between the Donor and the Organization via the Organization’s payment gateway.

3. Eligibility and Access

3.1 Donors must be legally capable of entering into a binding contract under Indian law.

3.2 Organizations must ensure that:

  • They are legally registered and authorized to accept donations
  • They comply with all applicable laws, including tax and charitable regulations

3.3 DonationPe reserves the right to suspend or terminate access for violations of these Terms.

4. Donations

4.1 All payments made through DonationPe are voluntary donations and not purchases of goods or services.

4.2 Donations are made for the benefit of the selected Organization and campaign.

4.3 DonationPe does not guarantee:

  • Any specific outcome
  • Utilization of funds
  • Performance or conduct of any Organization

5. Refunds and Cancellations

5.1 DonationPe does not process refunds.

5.2 Refunds, if any, are:

  • At the sole discretion of the Organization
  • Processed manually by the Organization through its own payment gateway

5.3 Donors must contact the relevant Organization directly for any refund requests.

5.4 DonationPe shall not be liable for:

  • Denial of refunds
  • Delays in refund processing
  • Refund-related disputes

6. Receipts and Tax Benefits

6.1 DonationPe facilitates generation of donation receipts, including 80G receipts, based on information provided by the Organization.

6.2 The Organization is solely responsible for:

  • Accuracy and validity of tax exemption claims
  • Compliance with Income Tax laws
  • Any consequences arising from incorrect or invalid receipts

6.3 DonationPe does not provide tax advice.

7. Organization Responsibilities

Organizations using DonationPe agree to:

  • Use the Platform lawfully and ethically
  • Maintain accurate information
  • Ensure compliance with all applicable laws
  • Handle donor communication and disputes
  • Process refunds, if applicable
  • Use donations strictly for lawful purposes

DonationPe is not responsible for the acts, omissions, or representations of Organizations.

8. Platform Fees

8.1 DonationPe may charge a platform service fee, which may be calculated as a percentage of transactions or otherwise.

8.2 Fees may be revised from time to time and communicated to Organizations.

9. Intellectual Property

9.1 All intellectual property related to DonationPe, including software, logos, designs, and content, belongs to Webenor Technologies Private Limited.

9.2 Users are granted a limited, non-exclusive, revocable license to use the Platform in accordance with these Terms.

10. Prohibited Activities

Users must not:

  • Use the Platform for unlawful or fraudulent purposes
  • Attempt to access unauthorized systems or data
  • Misrepresent information
  • Interfere with platform security or operations

Violation may result in suspension or termination.

11. Limitation of Liability

To the maximum extent permitted by Indian law:

  • DonationPe shall not be liable for:
    • Misuse of funds by Organizations
    • Disputes between Donors and Organizations
    • Indirect, incidental, or consequential damages

DonationPe’s liability, if any, shall be limited to the platform fees received by DonationPe for the relevant transaction period.

12. Indemnification

Organizations agree to indemnify and hold harmless DonationPe, its directors, officers, and employees from any claims, losses, or liabilities arising out of:

  • Their use of the Platform
  • Violation of laws
  • Disputes with Donors or authorities

13. Suspension and Termination

DonationPe may suspend or terminate access:

  • For breach of these Terms
  • For legal or regulatory reasons
  • To protect platform integrity

Termination does not affect accrued rights or obligations.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India.

All disputes shall be subject to the exclusive jurisdiction of courts in India.

15. Changes to Terms

DonationPe may update these Terms from time to time.

Continued use of the Platform constitutes acceptance of the revised Terms.
